Definition of plagiarism

Plagiarism in the modern meaning of the word, originated from Latin word plagium, which means a kidnapping. It is a serious violation of an intellectual property of an author. The problem consists of a deliberate copying of either a fragment or a whole work and its conscious publication under somebody else's name or without the source of the original work. The content in danger of becoming plagiarized may be either a text, an image, a picture, a scholarly article, a Master's thesis or even an invention. However, it is really difficult to establish unambiguously, whether a copyright infringement has happened or not, because according to a definition, plagiarism is a deliberate and intentional action. Plagiarism according to the Polish law

According to the Polish law (art.16 of the Act on Copyright and Related Rights, an access to the translation of the Polish Act), the link between the author and his work entitles him to; sign the work with his name, pseudonym or to make it available to the public anonymously, to control the manner of using the work, to have the content and form of the work inviolable and properly used and to decide about making the work available to the public. Any person who converts the authorship of a work, misleads as far as the authorship is concerned or distributes the work in its original or reproducted form without permission, is liable to a fine, restriction of liberty or imprisonment up to 3 years (art. 115 & 116 of the Act on Copyright and Related Rights).

International law

Penalties for the copyright infringement vary from state to state. For example in the USA, any person who willfully infringes a copyright for purposes of commercial advantage or private financial gain, or reproduces and distributes the work, shall be imprisoned not more than 10 years, or fined not more than $150,000 (see 18 U.S.C. §2319 and 17 U.S.C. §506).

Due to the international conventions, for example the Berne Convention for the Protection of Literary and Artistic Works, all of the works are under copyright law from the moment they come into being. The Berne Convention for the Protection of Literary and Artistic Works, concluded in 1886, was the first convention that concerned copyright between sovereign countries. Since then, the Convention was frequently amended, to reach its final form in 1979. The United States, after initial hesitation, ratified the Convention in 1989 and now is one of the 167 states that are parties to the Berne Convention. By the Berne Convention, authors of each membership countries are treated equally, copyright is granted automatically and doesn't require any registration. According to the Convention ((Art.7(1)), all works are copyrighted for at least 50 years after the author's death.

DMCA, which stands for the Digital Millenium Copyright Act is a United States copyright law, implemented in 1998.
