Definition of plagiarism

Plagiarism in the modern meaning of the word, originated from Latin word plagium, which means a kidnapping. It is a serious violation of an intellectual property of an author. The problem consists of a deliberate copying of either a fragment or a whole work and its conscious publication under somebody else's name or without the source of the original work. The content in danger of becoming plagiarized may be either a text, an image, a picture, a scholarly article, a Master's thesis or even an invention. However, it is really difficult to establish unambiguously, whether a copyright infringement has happened or not, because according to a definition, plagiarism is a deliberate and intentional action. Whereas the action cannot be called deliberate if a person does not realize that s/he is stealing someone else's content. Especially that nowadays the great majority of works bears signs of borrowing and processing other people's work.

Plagiarism according to the Polish law

According to the Polish law (art.16 of the Act on Copyright and Related Rights, an access to the translation of the Polish Act), the link between the author and his work entitles him to; sign the work with his name, pseudonym or to make it available to the public anonymously, to control the manner of using the work, to have the content and form of the work inviolable and properly used and to decide about making the work available to the public. Any person who converts the authorship of a work, misleads as far as the authorship is concerned or distributes the work in its original or reproducted form without permission, is liable to a fine, restriction of liberty or imprisonment up to 3 years (art. 115 & 116 of the Act on Copyright and Related Rights).

International law

Penalties for the copyright infringement vary from state to state. For example in the USA, any person who willfully infringes a copyright for purposes of commercial advantage or private financial gain, or reproduces and distributes the work, shall be imprisoned not more than 10 years, or fined not more than $150,000 (see 18 U.S.C. §2319 and 17 U.S.C. §506).

Due to the international conventions, for example the Berne Convention for the Protection of Literary and Artistic Works, all of the works are under copyright law from the moment they come into being. The Berne Convention for the Protection of Literary and Artistic Works, concluded in 1886, was the first convention that concerned copyright between sovereign countries. Since then, the Convention was frequently amended, to reach its final form in 1979. The United States, after initial hesitation, ratified the Convention in 1989 and now is one of the 167 states that are parties to the Berne Convention. By the Berne Convention, authors of each membership countries are treated equally, copyright is granted automatically and doesn't require any registration. According to the Convention ((Art.7(1)), all works are copyrighted for at least 50 years after the author's death.

According to the Latin saying, traditionally associated with Hippocrates: morbum evitare quam curare facilius est, i.e. “prevention is better than cure”. Paraphrazing this principle, preventing plagiarism is better than penalizing for doing it. Hence, we present 3 most common and most effective ways of preventing the larceny of content.

Basic plagiarism protection

First things first, you should inform about the copyright protecting the content. A simple copyright note or a © symbol, even though not required from the legal point of view, would serve an informative as well as cautionary function. Usually a copyright information conveys a meaning “Do not steal my property”. Once a note is visible on a website, a thief cannot excuse himself for not knowing that the content was protected and a possible plagiarism will be considered as deliberate and intentional.

An anti-plagiarism system

Another way of preventing the theft of your content is to insert a reference mark to your website. There are two ways to present the reference, either in a footnote, for example 2014© or incorporated in the content. The latter method is more time-consuming, but on the other hand there is a greater chance that your content will remain signed by your name. Inserting an advertising banner stating: “Website protected by Do not copy.” is also an excellent idea. It serves an informative function about the anti-plagiarism software Copyact protecting the website. The banner is available to download for free at out website.

The last reliable method of protecting your copyright is to mark your content with a unique signature, an identifier which will be an inseparable part of your content. Copyact offers a service of assigning electronic signature to your files, which not only marks the content but also adds a time marker to it. Time markers helps to prove that the content is original and has been created before a detected copy.

Unfortunately neither of the method mentioned above can guarantee that your copyright will not be infringed, however, these are the fundamentals of claiming your rights, especially if the lawsuit is in prospect. But you don't have to worry about plagiarism, if you have proper tools for protecting your content.

The phenomenon of unauthorized duplication of content, i.e. plagiarism, is becoming more and more common every year. It has been estimated that over 63% of the content published online will be plagiarised in 2014. In the face of the growing problem, which is both unauthorized text and image use, it is worth learning what we, as the users of the Internet community and potential victims of plagiarism, can do when we find out that the content of our website, or the website itself, has been duplicated.

Things you can do once you find plagiarism

It is possible that after your intervention, the plagiarised content will disappear. You would be well advised to refer to the law in force, for example the Berne Convention or the copyright law, to emphasize the severity of the situation. However, if this method fails, we have the arsenal of other arguments to our disposal.

DMCA takedown

Another action that you can undertake is to file for a deletion of the stolen content to the online service provider. It is also a good idea to report a copyright violation to Google, which is able to delete the web search results violating the copyrigh on the basis of the Digital Millenium Copyright Act (DMCA). According to the latest information, each week Google receives about 6 millions requests to remove the content from search results. A huge amount of takedown notices proves that plagiarism is a thorny issue.

Verification of the content's authenticity

Yet another thing that you can do to protect your content is to get a notarial deed certifying that the author's content has been plagiarized. However, it is rather costly and time-consuming. A much better solution is to issue a certificate of authenticity offered by You can now secure your content and validate its authenticity in no time and without leaving your house.

In the last resort, we can file a suit, but it is associated with a need to prove the priority of creating the content as well as the priority of publishing it. It is worth mentioning that offers authenticity certificates confirming the authorship of the data, which may be significant during the process of proving your authorship in court.

Fortunately, there are various ways to fight for your rights online. It is crucial to take any action, because once you are idle, you give a permission to steal your content, and noone likes to be robbed. This is why you should take matters into your hands and protect your content.

DMCA, which stands for the Digital Millenium Copyright Act is a United States copyright law, implemented in 1998. On the basis of the DMCA, companies such as Google take actions concerning the copyright infringement on the Internet. Let's see what the Act consists of and why it is so controversial.

Content of the DMCA

The DMCA implements two treaties of the World Intellectual Property Organization (WIPO), which amend the U.S. copyright law and extends its reach and limits the liability of the online service providers for copyright infringement by its users. According to the DMCA, production and distribution of technologies, devices or services in order to avoid the copyright law is considered a crime. The DMCA has also heightened the penalties for copyright infringement online.

Actions possible due to the DMCA

Due to the DMCA's regulations, companies like YouTube, which may contain infringed materials, are protected. As a matter of fact it is users responsibility, as they were required to accept the site's conditions of use, which they failed to obey. The website is responsible for blocking or deleting the infringing content if they receive a takedown notice. DMCA also makes it possible to issue subpoenas against online service providers to reveal the user's identity.

Google vs DMCA

Basing on the DMCA, Google has introduced an option of deleting the search results, which infringe the copyright. It is enough if you file a form, indicating which Google product the infringement concerns and where the original as well as copied material is located. According to the Google report from 2005, more than half of the Google takedown notices (57%) were invalid, as they were targeting the competing business' sites.

Criticism of the DMCA

The DMCA opponents claim the Act to be unconstitutional and violating the principle of the freedom of speech. The online service providers are accused of acting overhasty with reactions to the takedown notices, deleting the content which don't infringe the copyright.
